Hence, we are responsible for the collection, processing, obtaining consent, consent of use and use of personal data within the legal framework of the Federal Data Protection Act (BDSG), the German Telemedia Act (TMG) and the General Data Protection Regulation (GDPR).

When collecting data, the principle of data minimization is of great importance to us. We collect and process personal data only if you have given us consent for, or if the law expressly permits or requires us or if you permit us to do so. In the following provisions, we will explain what data we collect and store, how we use it, and what rights you have in relation to the use of your data:

By agreeing to the following privacy policy, you consent to the collection, processing and use of your personal data in compliance with the data protection laws and the following provisions.

§ 2 Collection, Storage and Use of Personal Data

  1. Personal data: The concept of personal data is defined in the Federal Data Protection Act or according to Art. 4 No. 1 GDPR. Thereafter, these are individual details about personal or material circumstances of a specific or identifiable natural person. This includes, for example, your civil name, your address, your telephone number or your date of birth. In addition, this also includes company-related data.
  2. Collection: When visiting our websites, unless otherwise stated in the following provisions, no personal data will be collected, processed or used when using our websites. a) Contact: If you contact us by e-mail, contact form or product inquiry form, we will save your e-mail address and other details. This is done solely for the purpose of responding to you or, if necessary, contacting you again at a later date regarding the subject of the inquiry, in particular for technical or other support requests. The information may be stored in a help desk system or a customer relationship system (CRM System) for the purpose of processing inquiries or customer care. The personal data entered into the form and sent to us by e-mail via our e-mail provider for the purpose of communication or establishing contact with business subjects and subsequent business activities of our company will not be used for any other than these purposes. b) Customer account: By registering free of charge as a user in our shop (hereinafter referred to as registered user) you can create a customer account in order to receive pre-contractual and post-contractual services, especially our contractually associated services (e.g. ticket support, order overview, invoice download, returns management), for the purpose of dedicated customer care. Upon registration, you will receive an e-mail to confirm your registration (double opt-in procedure). As part of the registration process, we require your e-mail address and a username. Created customer accounts are valid only within the subdomain eshop.arvigortrading.com. If you decide to delete your customer account, your data will be deleted irrevocably, taking into account the statutory retention obligations. c) Author account: You can create an author account if you have received a pre-approved invitation to register as author or editor on our blog. For the registration, we require your e-mail address. Created author accounts are valid only within the subdomain blog.arvigortrading.com. If you decide to delete your author account, your data will be deleted irrevocably, taking into account the statutory retention obligations.
  3. Storage: a) Security: We store and process your personal data on our server in Germany. In addition, we protect your data through technical and organizational security measures to minimize risks associated with loss, misuse, unauthorized access and unauthorized disclosure or modification of data. For this purpose, firewalls and data encryption, for example, as well as physical access restrictions and authorization controls for data access come into use. We take measures to ensure that the personal data we collect is accurate and up-to-date. b) Applications: Job applications are only accepted online via our application form, or if necessary by e-mail, under tab Career in About us. For this purpose, your personal data (including full name, e-mail, cover letter, attachments) with regard to the job description will be stored only for purposes of the application. The transmission of your personal data during the application process is encrypted. Only the human resources personnel and the respective departments have access to your application data. No transfer of your application data to third parties will take place, unless you have given us your express consent to do so or if we have been given official instructions by law enforcement authorities. The complete deletion of your personal application data takes place six months after completion of the application procedure in order to be able to comprehensibly answer questions regarding your application or to meet our obligations to provide evidence. This deletion does not apply if statutory provisions preclude the deletion or require storage beyond the period of six months for the purpose of providing evidence or if you have expressly agreed to a longer period of storage. In case your application is successful, the application data provided for internal business matters can be further processed within the framework of your employment with us. c) Comments and reviews: Blog users or shop customers may add comments or reviews to individual blog posts or shop products. Follow-up comments or notifications of new blog posts can be subscribed to by users based on the double opt-in procedure, and they can also be unsubscribed at any time. In addition to the comments, the time of a comment input as well as the selected user name (pseudonym) and browser type are saved, in particular to filter spam. The IP address of the commentator is logged. This logging of the IP address is done for security reasons in the event that a comment violates the rights of third parties or illegal content is published. d) Duration: Your personal data will only be stored for as long as we need that information in line with the stated purposes or as long as required by law.
  4. Use: a) Contractual relationship: The collection and processing of your personal data is carried out in particular for the purpose of developing the contractual relationship, in particular for the purpose of: having knowledge about who our contractual partner is; verifying the entered data for plausibility and legal capacity of the users; establishing contractual relationships with you regarding the use of the websites and the services offered on them, structuring their contents, processing them and, if necessary, changing them; bring able to contact you with any queries; ensuring effective customer service and technical support; informing you about future offers. b) Communication: In addition to processing your data to process your purchase order, we also use your customer information to communicate with you regarding your orders, specific products or marketing campaigns, and to recommend our products or services that may interest you, regardless of whether you have subscribed to a newsletter. This is done on a balanced basis, by which your personal data is not shared with third parties for advertising purposes. c) Advertising: In order to permanently improve your shopping experience, we provide our registered customers tailored advertising in the most unobtrusive way possible. For this purpose, we use existing information (pseudonymized usage data) such as: receipt and read confirmations of e-mails, subscribed newsletters, your order and/or service history, date and time of visiting our homepage. Prior to the evaluation of the aforementioned data, the data is pseudonymized. Thus, we can evaluate the user behavior without specific personal reference in order to constantly improve our websites and services. You may object to the use of your personal data for advertising purposes at any time, either as a whole or for individual measures. An informal message in text form to the contact details below (e.g. e-mail or contact form) is sufficient. d) Legal basis: The legal basis with regard to processing of personal data in this Privacy Policy, unless otherwise stipulated, for obtaining consent is contained in Article 6 (1) lit. a) as well as Art. 7 GDPR, whereas the processing thereof for the fulfillment of a contract or the execution of pre-contractual measures including the processing of inquiries is based on Art. 6 para. 1 lit. b) GDPR. Processing thereof for the fulfillment of legal obligations is governed by Art. 6 para. 1 lit. c) GDPR. Further legal provisions for the processing of personal data result from Art. 6 para. 1 lit. d) to f) GDPR. Our legitimate interest in the processing of personal data pursuant to Art. 6 para. 1 lit. f) is based on the execution of our business activities for the benefit of our employees and our shareholders, unless otherwise stated. e) Revocation: You may informally revoke your consent to the use of your personal data at any time pursuant to Art. 7 para. 3 GDPR. If you revoke your consent to the use or transmission of your personal data for the purposes set forth in this Privacy Policy, we may no longer be able to provide you with access to our websites, applications or tools or to provide the services in accordance with this Privacy Policy and our Terms of Use to our users and customers.

§ 3 Cookies, Access Data and Shop

  1. Cookies: Interactions with our websites are tracked using cookies and the technologies stated below to customize them for your use. Cookies are small files that are stored on your hard drive. This allows for easier navigation and a high degree of user-friendliness of our websites. Of course, you can also view our websites without cookies, but a limitation of their functionality cannot be ruled out. Most browsers accept cookies automatically. You can prevent cookies from being stored on your hard drive by selecting not to accept cookies in the browser settings or through the corresponding settings in the cookie banner. A general possibility of objection to cookies for advertising purposes: http://www.youronlinechoices.com/.
  2. Access data: Our server in Germany collects data about every access, so-called access data, on the server, where these websites are located (in access log files). The access data include e.g. the name or URL of the accessed website, date and time of access, browser type and version as well as IP address. These access log data files are used without personal references to the user or other profiling according to the legal provisions, but only for statistical evaluations of the system, for the operational purposes, security and optimization of our websites. This protocol date is stored by the server for 6 months and then removed automatically. We do not object to the removal, but we nevertheless reserve the right to retrospectively check the log data if, on the basis of justified suspicion, there is any unlawful use or action.
  3. Shop: During your visit in our shop, we may use cookies (e.g. for temporary storage of your shopping cart, regarding your login status) and collect or store personal data to improve the user-friendliness, in the context of operating the shop and for order processing purposes. For example, we may store which products you have recently viewed to show you those products; your location or IP address and browser type for the purposes of VAT and shipping estimation; your shipping address to process your purchase order. a) Order process: When you are shopping in our shop, information such as name, shipping address, billing address, e-mail address, telephone number, payment details is necessary to process your order. For convenience, you can use your customer account information with your username and password. This information shall be used by us to send you, for example, information about your customer account; to process your order; to be able to create an invoice for you; to be able to respond to inquiries, requests for refunds or complaints; to settle payments and prevent fraud; to create a customer account; to comply with legal and tax requirements; to improve our shop offering; to send you marketing and discount offers. b) Customer account: If you choose to have an account during your checkout process, i.e. in the checkout form, we shall collect your name, address and telephone number in addition to your e-mail address to auto-complete this form for future purchases if you are logged in. c) Affiliates: We use a system of affiliates in our shop to optimize and analyze our product range. By means of so-called affiliate links, the products of our shop are advertised and linked, for example, on other external websites by our affiliate partners. Affiliate links can sometimes be understood as marketing. In return, our affiliate partners receive an agreed commission if users follow these links and take advantage of the linked offer. Therefore, it is important to us that we track the link and the progress of the user from point of clicking the link to the purchase order, so that we can pay our affiliate partners a fair and correct commission. This is why the affiliate links are supplemented by a cookie or additional URL values. These include, for example, an identifier of the affiliate partner, an identifier of the offer, an identifier of the user, previous URL path and time of visit. The identifiers of the users are pseudonymized, i.e. without personal data. If, however, the clicking of the affiliate link is completed with a purchase order, the user can be personally identified with the user ID for the purchase order made.

§ 4 Disclosure of Data

  1. Transmission: a) Third parties: Personal data will only be passed on to third parties or otherwise transmitted if this is necessary for the purpose of contract fulfillment or billing, on the basis of our legitimate interests or if you have previously consented. Within the framework of contract fulfillment and order processing, for example, the service providers we use (such as shipping companies or shipping service providers, shipping partners, freight forwarders, logistics service providers or fulfillment centers, banks or payment service providers) receive the necessary data for shipment and order processing. Thus, the data provided to our service providers may only be used to fulfill their contractual obligations. Any other use of the information is not permitted and is not carried out by any of the service providers entrusted by us. We will not sell or otherwise disclose your data to third parties without your consent. Anything else applies only to the extent that it becomes subject to a legal obligation (e.g. information provided to legal authorities within the scope of their statutory duties) or to the extent necessary to enforce our rights, in particular to enforce claims arising from the contractual relationship with you. By order of the competent authorities, we might be legally obliged to provide personal data as far as it is necessary for purposes of law enforcement, security or to fulfill other legal duties. b) SendCloud: To dispatch the order, we may use the shipping service provider SendCloud GmbH, Kanalstr. 10, 80538 Munich (“SendCloud”). Personal data will only be transmitted, if necessary, to SendCloud for the purpose of processing the order. Further information on SendCloud’s privacy policy is available at https://www.sendcloud.com/privacy-policy/. c) Third country: The disclosure and/or transmission as well as processing of personal data vis-à-vis and carried out by third parties, in particular an assigned service provider, takes place in a third country only on the basis of your consent, within the scope of our pre-contractual and contractual obligations, on the basis of a legal obligation or provision, or because of our legitimate interests. Third countries are defined as countries outside the European Union, Switzerland or the European Economic Area. Hence, the transmission, disclosure and processing of personal data in a third country is based on the requirements set out in Art. 44 et seq. GDPR, according to which the processing shall depend, among others, upon the conclusion of standard contractual clauses, upon special guarantees or the existence of an adequacy decision by the EU Commission with regard to the data protection level of a third country, such as the EU-US Privacy Shield with regard to the United States.
  2. Credit check: In order to offer you the best possible options for the choice of a payment method, we must protect you and us against misuse. For this reason, a credit agency may on our behalf, if reasonably necessary, carry out a creditworthiness check for every customer based on mathematical and statistical methods, pursuant to § 28b No. 1 BDSG, a so-called credit scoring procedure. In this respect, we may transfer personal data including your address data to: i) SCHUFA Holding AG, Kormoranweg 5, 65201 Wiesbaden, ii) Bürgel Wirtschaftsinformationen GmbH & Co. KG, PO Box 5001 66, 22701 Hamburg, iii) arvato infoscore GmbH, Rheinstrasse 99, 76532 Baden-Baden, iv) Verband der Vereine Creditreform e.V., Hellersbergstrasse 12, 41460 Neuss. The calculation of the probability value also incorporates your address data. We use the information obtained about the statistical probability of a default (probability value) for a balanced decision on the payment options to be provided to you. You can informally object to the transfer of your data to the credit agency at any time. A text message (for example by e-mail or contact form) is sufficient. We would then re-examine the decision, taking into account your point of view. In this case, however, the payment options which are in principle available to you may be restricted. We would not be able to provide you with advanced payment methods, and we will have to terminate them if necessary. Should you have failed to provide a due payment despite the due date, and we have been compelled to warn you twice in written form within a period of four weeks after the due date, then we may be obliged to provide your personal data to a credit agency. You would be notified in written form in due time and in accordance with legal obligations.
  3. Payment processing: Payment service providers are integrated on our websites to process payment transactions. a) PayPal: As part of an order-related payment transaction processed by the payment service provider PayPal, i.e. by credit card, direct debit or, if applicable, purchase on account or other payment methods integrated in PayPal, we shall transmit your personal payment data in encrypted form to PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. Stripe reserves the right to conduct a credit score check in order to provide the relevant payment method. For more information about Stripe’s privacy policy: https://stripe.com/privacy. c) Klarna: As part of an order-related payment transaction processed by the payment service provider Klarna, i.e. by credit card, direct debit or, if applicable, purchase on account or other payment methods integrated in Klarna, we shall transmit your personal payment data in encrypted form to Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden. Klarna reserves the right to conduct a credit score check in order to provide the relevant payment method. § 5 Google and other External Services

  1. Google Analytics: For the purpose of statistical analysis, we use Google Analytics, a web analytics service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA or Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”), on our websites. Google Analytics uses its own cookies. Google Optimize and Google Signals, tools integrated into Google Analytics, are used for A/B tests and for cross-device analytics (so-called cross device tracking) to optimize the user-friendliness of our websites. Cross device reports contain only aggregated data. Therefore, users are assigned a pseudonymous user ID across different end devices. In addition, cookies are stored text files on your computer, which allow your use of the website to be analyzed. The information generated by the cookie about your use of our websites will generally be transmitted to and stored by Google on servers in the United States. In order to prevent the personalization of this data, your IP address is anonymized by a reduction procedure. This means that the IP address of Google users is shortened within member states of the European Union or in other signatory states to the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transmitted to a Google server in the United States and anonymized there. Since Google is certified according to the EU-US Privacy Shield (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active), Google commits to ensure that the processing of data in the United States is carried out in compliance with the data protection requirements by the EU. Google will use the information on our behalf to evaluate your use of the website, to evaluate data from AdWords and the DoubleClick cookie for statistical purposes, to compile reports on website activity and to provide us with other services related to website activity and internet usage. In particular, we use the Google Analytics advertising features: remarketing with Google Analytics, reports on impressions in the Google display network, integration of the DoubleClick platform and Google Analytics demographic and interest reporting. The user can deactivate the Google Analytics advertising features or exercise his right of objection (opt-out) via the advertisement preferences manager: https://www.google.de/settings/ads?hl=en. An alternative is given by the NAI consumer opt-out at http://www.networkadvertising.org, which disables the use of cookies by third parties. Furthermore, Google is obliged not to merge the IP address transmitted by your browser within the scope of Google Analytics with other data. This is due to the data processing agreement that we have concluded with Google. You can also prevent cookies from being stored by changing your browser settings accordingly. However, we would like to point out that in this case you may not be able to use all the features of our website to their full extent. In addition, you can prevent the collection of the data generated by the cookie and related to your use of the website (including your IP address), i.e. the transmission to Google and the processing of this data by Google in general, by downloading and installing the browser plugin available under the following link: http://tools.google.com/dlpage/gaoptout?hl=en. You can also prevent Google Analytics from collecting this data by clicking on the following link and then deactivate Google Analytics (opt-out): deactivate Google Analytics. An opt-out cookie is set to prevent your data from being collected in the future when you visit this website. You can find more information on terms of use and data protection at: i) https://www.google.com/analytics/terms/gb.html or at ii) https://support.google.com/analytics/answer/6004245?hl=en and iii) https://support.google.com/analytics/answer/2838718?hl=en&ref_topic=2790009. We also use Google Analytics to analyze data from AdWords and the DoubleClick cookie for internal statistics. If you do not want this, you can deactivate this feature via the link http://www.google.com/settings/ads/onweb/?hl=en. Please note that Google is required by law to carry out these measures. We cannot accept any liability for Google’s level of compliance with these obligations.
  2. Google reCAPTCHA: To improve data security during the collection and transmission of personal data in the input masks on our web pages and/or for the defense against spam, we use the service reCAPTCHA by Google Inc. This service is intended to distinguish, whether an input is manual or malicious through automated processing (e.g. bots). The IP address and any other data required by the reCAPTCHA service is sent to Google. Google’s privacy policy is available at https://policies.google.com/privacy?hl=en.
  3. Google Maps: In order to display interactive maps, we use the Google Maps service provided by Google Inc., which establishes a direct connection via the browser with Google’s servers to transmit the map content. Among other data, the IP address and location data of the user may be collected and processed, or a cookie can be set. If you do not want this, you can deactivate JavaScript in your browser settings. However, this can lead to a malfunction of our websites, even though you do not use the map function of Google Maps. Google’s terms of use can be accessed via https://www.google.com/intl/en_en/help/terms_maps/ or its privacy policy via https://policies.google.com/privacy?hl=en.
  4. Google Fonts: To display external fonts, we integrate the Google Fonts service provided by Google Inc. A connection to the Google server is established, through which Google can determine from which website your request is made and to which IP address the font is to be displayed. Divergences of Google’s privacy policy available at https://policies.google.com/privacy?hl=en.
  5. Google AdSense: We use the Google AdSense service (“AdSense”) or affiliate program from Google Inc. to include ads on our blog. This affiliate program finances a portion of our websites. The service only works through the use of cookies, which allow Google to track the share of advertising revenue generated by users of these websites. Google AdSense is used with personalized ads, i.e. AdSense can select and display individual ads based on user profiles. In this regard, a user profile may include, but is not limited to, previous visits to and interactions with websites, search queries, use of applications, location and/or demographic information, especially targeting of audience listings, interest categories, demographics, and remarketing. In addition to cookies, so-called web beacons are stored on your end device via your browser. Through the cookies, your shortened IP address is transmitted to Google Servers together with other pseudonymized usage information on the website or interaction with advertising formats, however, this data is not merged with other Google data. Contractual partners of Google can obtain this information. You can prevent cookies in your browser settings or via the cookie setup in the cookie banner on our blog respectively. This may lead to a limitation on the use of our website. Furthermore, you can also opt out of Google Ads at https://adssettings.google.com/authenticated. See https://policies.google.com/technologies/ads?hl=en for additional information about Google advertising and at https://policies.google.com/privacy?hl=en you will find Google’s privacy policy.
  6. Google Ads and Google Tag Manager: Our websites use Google Ads and Google Tag Manager by Google Inc. for personalized, interest-based and location-based online advertising on the Google advertising network and in the Google search results. We use the following Google Ads features: i) remarketing, ii) interest categories, iii) similar audiences, iv) other types of interest-based advertising, v) demographic and geographic targeting. These services enable us to address visitors of our websites with targeted advertising on the websites of our advertising partners as part of our marketing campaigns related to our products. This form of advertising is anonymous. Advertising on our partners’ websites is displayed using Google Ads and the Google Tag Manager based on a cookie technology (DoubleClick cookie) and visits to our websites. The data is transmitted to Google, collected and stored by Google. Our advertising partners do not receive any information about the data stored in the cookie. In addition to the IP address of the computer used, an ID number is stored in the cookie, by which Google can determine how often you have visited which website. Apart from the IP address, no other personal data such as e-mail addresses, company names or telephone numbers are stored. The data stored in the cookie is not combined with other personal data to form user profiles. This means that user profile data is processed anonymously. Users can prevent Google’s DoubleClick Remarketing Pixel by downloading and installing the available browser plugin at the following link https://www.google.com/settings/ads/onweb/ or at https://support.google.com/ads/answer/7395996?hl=en. Alternatively, you can disable DoubleClick cookies on the Digital Advertising Alliance website at the following link: http://www.aboutads.info/choices/.
  7. Google Suite: To minimize the burden on our server, to collect customer opinions and to publicly schedule events, we use Google Cloud services by Google Inc., specifically Google Drive, Google Forms and Google Calendar as part of Google Suite, to manage and store documents on Google Drive (such as our terms and conditions, revocation form), for calendar management in Google Calendar (e.g. events), to exchange and publish documents and information in Google Drive as well as to process anonymous customer feedback or surveys in Google Forms. No personal data is collected, stored, exchanged, processed or published. When using publicly accessible documents or contents, Google may place cookies on the user’s device for the purpose of statistical analysis or to save the user’s settings. Additional information in Google’s privacy policy: https://policies.google.com/privacy?hl=en. You can find further security information on Google Cloud at https://cloud.google.com/security/privacy/.
  8. CloudFlare: To improve security, such as preventing DDoS attacks on our server in Germany and optimizing loading times, we use CloudFlare Inc., 101 Townsend Street, San Francisco, CA 94107, USA (“CloudFlare”) under the conclusion of a data processing agreement as CDN (content delivery network) and proxy server, which stands between the server in Germany and the users of our websites. Cloudflare is certified under the EU-US Privacy Shield and hence ensures that the processing of data in the United States is conducted in compliance with EU data protection laws (https://www.privacyshield.gov/participant?id=a2zt0000000GnZKAA0&status=Active). In addition, we use our own SSL certificate in “strict SSL” mode in conjunction with CloudFlare: https://www.cloudflare.com/de/ssl/. In doing so, requests are filtered by the CloudFlare servers in the USA and data is anonymously aggregated in accumulated statistics. This access data (access logs) is collected via a Cloudflare cookie and usually remains with CloudFlare (https://blog.cloudflare.com/what-cloudflare-logs/) for up to 4 hours to optimize loading times and it will then be removed. Please find further information on data security at: https://www.cloudflare.com/privacypolicy/.
  9. VG Wort: Our blog uses the “Scalable Central Measurement Method” (SZM) by INFOnline GmbH, Forum Bonn Nord, Brühler Str. 9, 53119 Bonn (“INFOnline”), to determine statistical ratios by anonymous readings, which are used to calculate the copy probability of individual texts for the statutory compensation of authors and publishers. Therefore, so-called  measurement pixels are integrated on the blog, by means of which the Verwertungsgesellschaft Wort (VG Wort), a legally competent association by virtue of the award, Goethestraße 49, 80336 Munich, recognizes the usage behavior with regard to the content retrieved. When recording the number of hits, a session cookie is usually set for the pseudonymized recognition of a user on the website. The IP addresses are processed in an anonymous form without any inference about the person. Whereas a shortened IP address is stored for up to 60 days, the pseudonymized usage data is stored for up to 6 months. You can object to the collection and processing of data by INFOnline related to the blog by clicking the opt-out button under the link http://optout.ioam.de so that an opt-out cookie is set. For additional information about INFOnline’s privacy policy, please visit: https://www.infonline.de/en/privacy-policy/.

When you subscribe to the newsletter, we also store your IP address and the date of subscription. This collection of the IP address and the date of subscription serves solely as evidence in the event that a third party misuses an e-mail address and subscribes to the newsletter without any knowledge by the authorized party. We cooperate with the list provider MailChimp, an offer of the Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA (“Rocket”), to send our newsletter under a data processing agreement. Rocket is certified under the EU-US Privacy Shield (https://www.privacyshield.gov/participant?id=a2zt0000000TO6hAAG&status=Active), which requires Rocket to process data in the United States in compliance with EU privacy laws. Upon subscription, MailChimp will send you an e-mail to confirm your subscription (double opt-in procedure). In addition, MailChimp offers various analytical tools to measure newsletter interaction, e.g. how sent newsletters are opened and used, how many users have received an e-mail, whether e-mails have been rejected, and whether users unsubscribed from the list. However, these measurements are only aggregated, and they are not used by us for individual evaluations. MailChimp also uses Google Analytics by Google Inc. and MailChimp may include it in its newsletters. Further details about Google Analytics can be found in this privacy policy under “Google Analytics”. For more information about MailChimp’s privacy policy, please visit: https://mailchimp.com/legal/privacy/. 14. Embedded external content: External content from third parties (e.g. issuu, SlideShare, YouTube, SoundCloud, Google Calendar, Twitter Timeline) such as videos, RSS feeds, images and texts is embedded on our websites through an inline frame (iframe). Embedded content from third parties, i.e from external websites, basically behaves as if you were directly accessing those external websites. When accessing these contents, data may be transmitted to or collected by these third parties over whose scope we have no influence. This usually requires that the providers of this content obtain the IP address of the users, because without the IP address they could not send the contents to the browser of the respective user. The IP address is therefore required for the presentation of this content. We are encouraged to use only those contents, whose respective providers use the IP address only for the delivery of the content. Third parties may also use cookies and tracking or log the user’s interaction with the embedded content.

§ 6 Social Plugins and Social Logins

  1. Facebook: We use social plugins of the network facebook.com, namely the “Share” button. These plugins are offered by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA or Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland and they transmit data to Facebook. They are marked with Facebook “f”. By interacting with these plugins, your browser establishes a connection to Facebook’s servers. Since Facebook is certified under the EU-US Privacy Shield (https://www.privacyshield.gov/participant?id=a2zt0000000GnywAAC&status=Active), Facebook is committed to ensuring that data is processed in the U.S. in compliance with EU privacy laws. The content of the plugin is sent directly to your browser. The plugin is part of Facebook and is only displayed on our websites. Any interaction with the plugin is an interaction on “facebook.com” and not on our website. We have no influence over the content of the plugin. At the same time, Facebook places one or more cookies in your browser. Through the active plugin and the cookie(s), Facebook receives data even if you have not yet clicked on the plugin and even if you do not have a Facebook account. According to Facebook, this data includes the website visited, the date, time, browser type and version, operating system and version and, to our knowledge, IP address and Facebook cookies already stored in the browser. This allows Facebook to track which other websites with Facebook content (including these plugins) you have visited. Facebook uses this information to locate bugs in its system, to improve its own products and customize user behavior; to control, to place and to personalize advertisements, to locate and record the way Facebook content is used on websites, and conduct market research. If you are logged in to Facebook when the plugins are enabled, your Facebook login ID will also be transmitted to Facebook. This means that your visit to our websites can be directly linked to your Facebook user account. You will then be identified by Facebook with your Facebook username and your private data from the Facebook user account. In the case of interaction with the Facebook plugin, i.e. when you click on it, this information is not only transferred to the Facebook servers but, depending on the settings of your Facebook account, is may also be published on Facebook and shared with your friends. If you want to avoid this, you must first log out of your Facebook user account before interacting with the Facebook plugins and delete all Facebook cookies after visiting websites with Facebook plugins. According to Facebook, it stores all these data for up to 90 days. Facebook then anonymizes this data and uses it only in an anonymized and aggregated form, for example to improve advertising. Facebook’s plugins are set up in such a way that we do not receive any of the information transmitted with the plugin or Facebook cookies. We can only conclude that you clicked on the plugin at all and shared our content with others. For more details on how Facebook handles your information, please see Facebook’s privacy policy at http://www.facebook.com/about/privacy/.
  2. Twitter: We use social plugins of the Twitter short news service, namely the “Share” or the “Follow” button. This plugin is offered by Twitter, Inc., 1355 Market St., Suite 900, San Francisco, CA 94103, USA, and they transmit data to Twitter. The plugin is marked with the Twitter logo. By interacting with this plugin, your browser establishes a connection to the Twitter servers. Since Twitter is certified under the EU-US Privacy Shield (https://www.privacyshield.gov/participant?id=a2zt0000000TORzAAO&status=Active), Twitter is committed to ensuring that data is processed in the United States in compliance with EU privacy laws. The content of the plugin is sent directly to your browser. We do not have any influence over the content of the plugin. At the same time, Twitter sets one or more cookies in your browser. Through the active plugin and the cookies, Twitter receives data even if you have not yet clicked on the plugin or even if you do not have a Twitter user account. According to Twitter, this data includes the visited website, the previously visited page, the date, the time, the browser type, the operating system, your IP address, search terms used, your location, your mobile phone provider, your mobile device, your application ID and Twitter cookies already stored in the browser (so-called Twitter widget data). This allows Twitter to track which other websites with Twitter content (including these plugins) you have visited. Twitter uses this data in particular for its “tailored suggestions” service, which recommends certain “tweets” to you, to improve systems and products, to adapt to user behavior, to localize, to record the way websites with Twitter content are used and for market research purposes. If you are logged in to Twitter when you interact with the plugins, Twitter can connect to your Twitter user account. If you want to avoid this, you must first log out of your Twitter user account before interacting with the Twitter plugins and delete all Twitter cookies after visiting websites with Twitter plugins. According to their own information, Twitter starts deleting the widget data after 10 days, which can take up to 7 days. After that, Twitter only uses aggregated, anonymous data, such as how often a page with Twitter content has been accessed. Twitter’s plugins are set up in such a way that we do not receive any of the information provided by the plugin or through Twitter cookies. We can only conclude that you clicked on the plugin at all and shared our content with others.
